Terms and Conditions
1. General provisions
These terms of sale (the “Terms”) define the rights, obligations and responsibilities of the Buyer and AUTOVINPATIKRA.LT (the “Seller”) when purchasing products from the online store.
2. Formation of the sales contract
2.1. The contract is concluded when the Buyer has selected a product, entered an email address, selected a payment method, read these Terms and clicked “Order”. It remains effective until both parties have fulfilled their obligations.
2.2. Each contract is stored on the AUTOVINPATIKRA.LT server.
3. Buyer’s rights
3.1. The Buyer may purchase products in accordance with these Terms and Lithuanian law.
3.2. Under the wording of the original Lithuanian Terms, the consumer may notify the Seller in writing of withdrawal within seven working days of delivery, citing Lithuanian Minister of Economy Order No. 258 of 17 August 2001. This clause refers to an older legal provision and should be reviewed against current consumer protection legislation.
4. Buyer’s obligations
4.1. The Buyer must accept and pay for ordered products and their delivery.
4.2. Changes to registration information must be updated promptly.
4.3. Products are reserved and processing begins after confirmation of payment is received from the Buyer’s bank. Payment must be confirmed within 24 hours of clicking “Order”; otherwise, the Seller may consider the contract cancelled.
4.4. The Buyer must also comply with other obligations under these Terms and Lithuanian law.
5. Seller’s rights
5.1. The Seller may limit or terminate access without prior notice if the Buyer attempts to disrupt the online store.
5.2. The Seller may temporarily or permanently suspend the store without separate notice.
5.3. The Seller has other rights specified by these Terms and Lithuanian law.
6. Seller’s obligations
6.1. Enable appropriate access to the online services.
6.2. Arrange delivery of ordered products to the specified address or email address.
6.3. If supply becomes impossible due to important circumstances, offer an equivalent product; if refused, refund the paid amount within five working days, without liability for non-delivery in that case.
7. Delivery
7.1. Reports are sent to the email address specified by the Buyer.
7.2. The Seller must deliver the report within three working days after receiving payment.
8. Returns
8.1. The original Terms state that returns do not apply to virtual products and no refund is due for a successfully provided service.
8.2. The original Terms provide for refunds when the ordered product cannot be supplied. Statutory consumer rights may apply irrespective of these clauses.
9. Liability
9.1. The parties are liable for breaches of the agreement in accordance with Lithuanian law.
9.2. The Buyer and Seller agree in the original Terms that actions authenticated with store login credentials constitute an electronic confirmation with the legal effect described in the cited Lithuanian Electronic Signature Law provisions. The Buyer must protect credentials, not disclose them, and immediately notify the Seller if access details have been compromised. Actions taken using the Buyer’s credentials are treated as the Buyer’s actions under the original Terms. The applicable law and enforceability of this provision should be reviewed.
9.3. The Seller is not responsible for information provided on third-party websites, even when the Buyer follows a link from the store.
This is an English translation of the currently published Lithuanian Terms, not an independently updated legal policy.
